1. GENERAL

These Terms of Service govern the use of the CANDYCE DUVAL website and the purchase of products through our online store.

By accessing the website or placing an order, you agree to these Terms, together with our Privacy Policy, Shipping & Returns Policy and Legal Notice.

CANDYCE DUVAL is powered by Shopify, which provides the e-commerce platform used to operate this online store.

2. PRODUCTS

CANDYCE DUVAL jewellery is handcrafted, primarily using the lost-wax technique.

Because each piece is made individually, slight variations in shape, texture, finish or appearance may occur. These variations are part of the handmade nature of the jewellery and do not necessarily constitute a defect.

We make every effort to display products and colours accurately, but appearance may vary slightly depending on the device or screen used.

Product availability, descriptions and prices may be updated at any time.

3. ORDERS

By placing an order, you are offering to purchase a product from CANDYCE DUVAL.

You will receive an order confirmation after placing your order. We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of payment issues, pricing errors, suspected fraud or product unavailability.

If an order is cancelled by us after payment has been received, the corresponding amount will be refunded.

For handmade or made-to-order pieces, production times are indicated on the relevant product page.

If you need to modify or cancel an order, please contact us as soon as possible. Changes cannot be guaranteed once production or dispatch has begun. This does not affect your statutory consumer rights.

4. PRICES AND PAYMENT

All prices displayed on the website are in euros (€) unless otherwise indicated.

Prices include applicable taxes unless stated otherwise.

Shipping costs are shown or calculated during checkout before the order is confirmed.

For deliveries outside the relevant customs territory, additional customs duties, import taxes or local charges may apply. Where applicable, these charges are the responsibility of the customer unless otherwise stated.

Payment must be completed using one of the payment methods available at checkout.

5. SHIPPING AND DELIVERY

Orders are shipped to the delivery address provided by the customer.

Production and estimated delivery times are provided for guidance and may vary. Delays caused by carriers, customs procedures or circumstances outside our reasonable control may occasionally occur.

CANDYCE DUVAL remains responsible for the goods until you, or a third party designated by you other than the carrier, physically receive them, except where you independently arrange a carrier not offered by us.

6. RETURNS AND RIGHT OF WITHDRAWAL

Where applicable under consumer law, customers purchasing online have the right to withdraw from their purchase within 14 days from receipt of the goods, without having to provide a reason.

Where a product has been made to the customer's specifications or is clearly personalised, the statutory right of withdrawal may not apply, as permitted by applicable law. European Union

This exception does not affect your rights if a product is defective, damaged or does not conform to the order.

7. LEGAL GUARANTEE AND CONFORMITY

Customers benefit from all mandatory consumer guarantees provided by applicable law.

For goods sold to consumers in Spain, CANDYCE DUVAL is responsible for a lack of conformity that exists at delivery and becomes apparent within three years from delivery.

Where legally applicable, a defective or non-conforming product may be repaired or replaced free of charge. If this is impossible or disproportionate, the customer may be entitled to an appropriate price reduction or refund.

Nothing in these Terms limits any mandatory consumer rights.

8. RELATIONSHIP WITH SHOPIFY

CANDYCE DUVAL is powered by Shopify, which enables us to provide the Services to you.

9. INTELLECTUAL PROPERTY

All content available on this website, including jewellery designs, photographs, images, text, graphics, logos and branding, is owned by or licensed to CANDYCE DUVAL unless otherwise stated.

Content may not be copied, reproduced, distributed, modified or used for commercial purposes without prior written permission.

10. PRIVACY

Personal information collected through the website is processed in accordance with our Privacy Policy.

Our store is hosted by Shopify, which processes certain information necessary to provide the e-commerce services used by this website.

11. LIABILITY

Nothing in these Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited.

CANDYCE DUVAL is not responsible for losses resulting from improper use of the products, normal wear and tear, or circumstances outside our reasonable control, except where liability cannot legally be excluded.

12. GOVERNING LAW

These Terms are governed by Spanish law.

If you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protections granted by the laws applicable to you.

Any dispute will be subject to the jurisdiction of the competent courts determined under applicable consumer law.
